28 h contracts offered but not followed through and workplace bullying / homophobia.

Hi All,

Hopefully someone can give us some guidance on problems at work, basically we have two issues, the first is with the contract and the second is with workplace bullying, which i beleive does ultimately link up.

I work for a large company and have done so for 2 years on a 0 hours contract, which was standard across the company.

Three months ago the company decided to offer contracted hours to all employees and I was initially offered 16 (although i was working between 30-40 hours a week) the restaurant manager and regional manager disagreed with this and I was then verbally offered 28 a week, however the paperwork never arrived, the manager made several calls to HR and to the regional manager who said he would sort it, there were also emails back and forth.

The manager is currently off sick and a new manager is now saying that i am only getting 16 hours and has reduced my hours to this effect, I have paperwork showing that I was being offered 28 from the regional manager however coincidently all emails have now been deleted, and the regional manager isnt playing ball.

On the paperwork I have it also shows they were also offering more hours to another member of staff on the same grade and she has received her new contract.

Firstly can they now retract the offer of 28 hours? If not what should i do? Secondly they have more than halved the hours that i work but employed 2 more people to do my job.

To add insult to injury there are also three other members of staff contracted at 16 hours who have not had their hours cut and still working fulltime so clearly its only me, i have asked if my work is not up to standard and been told i am the best supervisor in there, so it really doesnt make sense.

On my second request but tied in with the first one, I am really starting to feel like i am being victimised, my hours have not only been cut but now i only work weekends unless they are desperate, but they also put me on late then earlies (12pm - 8pm and the the next day 6.30am - 3pm) i have a 2 year old son and that means i do not see him nor him see me for almost 28 hours.

Sorry I should point out the original manager is my civil partner and the new manager is rather homophobic although i cant actually prove it other than the fact she has 'got rid' of 2 and stated that 1 will be gone pronto.

She screams and ridicules me in the restaurant, Ive tried recording it but its too noisy and doesnt pick it up, and other staff wont back me up in fear of their jobs, leaves notes about jobs to do, makes threats about my partners job (one one occasion said that if i went sick she would pull the office apart and make sure my partner never worked there again) and she make accusations about me to other staff that are simply not true.

She also refuses to give requested holiday in July saying its too far away, even though i know noone else has booked it off and she has holiday booked as far away as next March

Its clear she is trying to get me to leave but i am determined that she will not win, she cant just get rid of me as i have a impeccable history and she knows i work damn hard, ive never had a day off sick.

Sorry, i know this is soooooooooo long winded but i need some help because i really dont know where to go with it, ive tried phoning ACAS but they didnt really listen to whole long saga.

should add i have a recording of her saying everyone is only going to be doing their contracted hours but its rubbish as i have the rotas showing different.

and also adding to the homophobia, this woman also refuses to employ blacks, asians or any sort of foreigner, but is very clever cos its always said verbally, however there has NEVER been an employee of a minority race, one mixed race young girl she got rid of through disciplinary on mickey mouse reasons.
