Issue with car dealer after trade in

Hello all,

I'm after some advice as regards my consumer rights after trading in my car with a small car dealership.

I traded in my old car which was an immaculate example BMW for a diesel Passat on the 15th of this month. After only 2 hours of taking the car away the wheel bearings failed in one of the wheels while I was driving on the motorway. The cause was the sales guy had put the wheel back on the car himself after they were investigating a slow punture and he did not fit the wheel correctly. Needless to say I was very irate. The wheel bearings were replaced but since then I have had several more problems with the car all of which I am being told will be rectified. Only some have.

In the last day or so the car has now bgean to leak coolant and I have told the garage I no longer want the car I bought and that I wanted my old car back as well as the €2500 I paid extra. I have no confidence whatsoever in the car or the mechanics the garage have employed to perform the repairs. Where do I stand on this matter legally? I have no intentions of keeping the Passat as I do not feel safe driving it in case something else should fail or the imcompetent mechanics do not do their jobs correctly. Any help/advice is much appreciated.

Might be no harm to chat with a solicitor with experience in this area. I would not feel safe in that car either.

Has the dealer still got your car or has he sold it on to someone else in the trade. Is the dealer a member of SIMI. If he is I would get onto them as well.

Look at other main car dealers and see so many second hand Vw's sitting waiting for buyer's. Not a good sigh! when buying a Vw these days you are buying trouble. They are only worth buying brand new and flog them before the poxy two year warranty runs out!

The dealer does still have my car. Was told a few lies already, like my old car was sold when it clearly hasn't. I'm not sure if they're a member of SIMI. No SIMI label on their website. I was advised to get on to them (SIMI) as well. I will be contacting SIMI on Tuesday to see if the car dealer I am having problems with are affiliated with them.

There are a lot of second hand VW's for sale and what I am amazed at is the price of them and especially the diesel models. I have one and I like the car. Looking on carzone, they are way overpriced and some of them have quite high mileage.

Good idea. I never buy a car from a garage now. I always buy privately. I know a lot of people will say that you have a warranty from a garage. However I would rather get value from my hard earned cash than giving it to these dealers. The last car that I did buy from a garage was a nightmare with things going wrong that were supposed to have been fixed before sale e.g. a full service which was clearly not done.


I would definitely follow up with SIMI to see if this dealer is registered with them. Usually you will see the SIMI Logo somewhere displayed on the premises. Where is this dealer as a matter of interest?

South Dublin. I'm not naming names just yet as I feel this is just the start of long drawn out legal process.
