Small question if one was driving through a machine car wash, one keyed in pin number car wash started and then stopped no where to go so drove backwards thus taking the side wing of a new car.... who is at fault!!!! garage or person driving, car was aligned straight as machine would not have started otherwise
 
The person driving is at fault IMO
Did they not look where they were going?
What if it was a child that they reversed into?

The car wash stopped and they had no other alternative but to go foward or backwards and yes they did check to make sure no child or adult was behind them before they reversed...
 
Nothing was hit with the car, while reversing the car out of the stopped unfinished car wash the lady damaged the side of her car...
 
Usually there are instructions somewhere on the car wash about what to do if there's a problem (ie sit in your car and sound your car horn to get assistance). Was there anything like that on the car wash?

How was the side of the car damaged if they didn't hit something? :confused:

Driver is at fault.
 
I don't know its was just an incident I saw yesterday.............. machine stopped while washing

a) why did they reverse out when they should have gone forward?
b) even if the machinery stopped, by definition it is wider than the vehicle and therefore even reversing out, they shouldn't have hit anything. Bad driving caused them to hit.
c) there are usually disclaimers plastered around a car wash to say that no liability attached to the garage in the event of damage caused by the car wash.
 
ally -- they are all incorrect. The same thing happened to my wife a number of yeas ago whence we lived in Dublin. She drove into the Car wash and the sensors on the car wash failed to work and it damaged the car to the tune of over £3k (just before the euro came in). She went into the bloke at the tills and told him and he mentioned that there was a problem with the machine, but there was nothing he could do. She went off to collect kids, so phoned me and I went to the garage. The Manager was there then and he denied everything. The other bloke who saw everything had been sent home, so I took a few photos of the machine when not operating correctly, the got my solicitor to write immediately. Was called to a meeting within a week and they agreed to pay for the damage and my legal fees. So VERY SIMPLY -- THOSE THAT THINK MACHINES NOT WORKING CORRECTLY ARE ALLOWED CAUSE DAMAGE TO CARS AND THEN BLAME DRIVERS ARE INCORRECT. And the Garage was in Dublin South.

Your one case does not prove nor disprove anything about this incident and there really is no need to shout about it.

What you have posted about the sensors not working and sub sequentially the car wash damaging the car don't appear to be the same as the OPs story about the car being reversed into part of the car wash.

It proves two things -- the sign of 'not accepting responsibility for damage caused' doesn't mean a damn, and it proves if the machine was not functioning correctly, the owners are liable. My case does prove that the owners of the car wash were responsible and in this case if the person concerned was forced to reverse, then its a problem with the machine, simple as that. I'm not shouting about it but the question was asked and I am allowed to give a true definite answer, unless somebody with a vested interest doesn't like it.

Forced is a strong word. Chose is another.

The case isn't as clear as you appear to be making it out as the car was moved. If the garage can demonstrated that the car could have been reversed out whilst the washer is in position then the case favours the garage as it would appear to be human error. I wonder did the OP take photos of the car and positions of the washer.

As a side who in their right mind puts a new car, or any car for that matter through one of these car washes. Madness.

She crashed into the car wash! Who "forced" her to reverse into it?
 
If the driver was unable to move forward as the machine was blocking the way through, then the person concerned had to reverse. Nobody forced her to reverse, but the machine was not working in the manner it is supposed to so she had no option other than to reverse. So are you saying that if the machine damages a vehicle whilst in operation the machine owners cannot be blamed ? There is already a test case in respect of this kind of thing.
 
But the machine didn`t damage the vehicle whilst in operation!....She decided to reverse into it!
