If you pay a deposit for goods or services which have not been supplied & fitted as agreed. Would you be able to take supplier to the small claims court to return your deposit or do the work?
 
So long as the claim is within the €2,000 limit, yes.

In terms of arguing a case about whether something was 'fitted as agreed', the more details that were put in writing, the stronger your chances of success. A verbal agreement will likely be difficult.
