Dear All - is an employer entitled to keep their calculations of an ex gratia payment secret from the employee being made redundant? The company has provided the figure for total payment being offered and the amount of the statutory element within that.
Obviously a simple subtraction gives the ex gratia, but it does not correspond at all to the weekly wage, making it impossible to understand what is being taken into account in that calculation. From my reading of the redundancy law I believe the company must provide the details of the calculation. Am I correct or are the company within their rights to keep that confidential?
