I have had a person view a room recently and say that HAP will pay part of their rent. However the rent is more than the HAP allowance.

Does anyone know if it is legal for me to accept a top up payment directly from the tenant.

Thanks

Additional rent payments and deposits
If your rent is more than the HAP limits allowed for your household, you must pay the additional amount directly to your landlord. However, your local authority must make sure that your tenancy is sustainable, so you will not get a HAP payment if you can’t afford the rent.

Yes I get HAP for a tenant and also an additional payment from the tenant. Works very well, no issues.
