Is it possible for the payer to cancel a Direct Debit without the originators consent in the case of a fixed term mobile phone billpay contract. Obviously, this would be a breach of contract but, regardless, would a written instruction to the bank be sufficient to prevent the money being paid out?
 
You can cancel any DD on your account , the billpay contract is a separate issue.

So put in writing to your Bank to cancel DD , and have them confirm your instrucyion.
 
If you have online banking you will probably be able to cancel the DD through that. I've often done it on PTSB online.
 
When you sign a DD mandate you are telling your bank that you give the phone provider permission to take money from your account. You can withdraw that permission at any time. You can either do this using your online banking, or by sending in a letter to your bank.
You do not have to inform your phone provider and they won't know about it until next time they try to take a DD and it gets refused. Also the bank won't care why you are doing it.
 
You could invoke the protection provided by SEPA. Any payment within the last eight weeks can be refunded

Request a refund for any SEPA Direct Debit within eight weeks from the date on which the SEPA Direct Debit was debited from their account. Within the eight week period their bank must refund on a ‘no-questions asked’ basis.

Does the bank then reclaim it back from the originator, they hardly take the hit.

n my experience they will try and reclaim it back from the originator, it similar to a chargeback on credit card transactions.

The originator is the one who takes the hit, the bank reverse the original transaction in the originators bank account as if it was a bounced/rejected direct debit
