business idea but discovered it done elsewhere

Hi, I have a had a great business idea a year ago and am starting to look more into it to it to get it off the ground. However, after a bit of research i have discovered that the same idea has been done in another country, in New Zealand and Australia. Where does this leave me in Terms of names, leagality etc.?
Sorry if this question sounds silly as I know there are companys/sole traders out there that manufacture same product etc. and it's all about competition but I'm really surprised that the name I came up with is taken along with my idea.

Any advice would be great........
 
As regards the name, surely a very small change is all that is required?

e.g. "Joe Bloggs Concrete" v "Joe Bloggs Concrete International"

You wouldn't want people to be confused between you and competitor(s) though. I'm assuming that the name you had in mind reflected the service you intend to provide?
