Asking on behalf of a relative.

Has been working full time for 30 years, and was made redundant in November. During that full time employment also did some self employed work. Returned F11 each year for this.

On application to DSP for JSB was refused on the basis of self employment.

Can anyone tell me why this is so? Paid full PRSI on FT employment up to date of redundancy.

I can understand if someone was fully self employed and paying the lower PRSI rate for that, but to have paid full PRSI all along, and NO benefits. Seems unfair to me.

DSP office adamant no payment whilst self employed. Self employment is one night a week only and minimal income from it.

The self employment has also dried up now. Awful situation for family.

Any advice most welcome.

Check the rules on subsidiary employment,as this case would seem to fit in with that rule.

4. Subsidiary employment
As a general rule, you will not get Jobseeker's Benefit for any day you are employed or self-employed. However, it is possible to do some subsidiary work and still get Jobseeker's Benefit for the day in question.

Subsidiary work is work that could have been done while you were in full-time employment and outside your normal working hours. For example, you may work a full-time job during the day and have a part-time job in the evening. The part-time job is known as subsidiary or secondary employment if you were able to do the part-time work without it affecting your full-time job for a period of at least 6 months.

If you have subsidiary employment, you should always check with the Department of Social Protection (DSP) to see whether or not your Jobseeker's Benefit will be affected.

If you have less than 117 paid PRSI contributions in the three years before becoming unemployed, you may not earn more than €12.70 a day from subsidiary employment. There is no earnings limit if you have more than 117 paid PRSI contributions.

If you are a farmer with other full-time employment, your farming will be your subsidiary employment.

That works fine for a second employment but it might be the self employed nature of the second job that is the problem, I was also told that you cannot get JB if you are also registered as self employed. Maybe if that self employed income is now gone I would go back and appeal on that basis, it might mean de-registering or whatever is necessary with Revenue for that self employment.

And to add to the misery, the company worked for has no money to pay out redundancy, so it has to go through the DSP channels for statutory, and nothing yet.

@ Monbretia, I think what you said is what was indicated.

In the DSP office, the officer saw that self employment was returned (a Saturday night, 4 hours) and said NO.

She said if you de register from IT we will look at it again.

So OK, a person works full time for 30 years, pays full PRSI all those years. DECLARES a piddling bit of self employment, and is entitled to NOTHING, but is being encouraged to work on the Black in order to get 188 a week!!

You really couldn't make this up.

But anyway, the subsidiary employment paragraph in the CA website mentions self employment, but it is not very clear either.

Looks to me that paying full PRSI is useless unless you do NOT register for IT for any little bit of self employment. That is so counter productive.

As I said before the person is not FULLY self employed, just a few hours a week. If it hadn't been declared/returned would have got the dole. Seems very strange to me.
 
I had kind of similar scenario, was getting JB and wanted to register for self employment to maybe do one or two small jobs per week if even, might only have been once a month. it was also something that would have had no impact on working a normal day job too should I have been so lucky as to get one but was told once I registered as self employed I would immediately lose the JB. I also had worked for over 30 yrs paying all that time and had been made redundant, luckily though with a payout.
